The Government Information (Public Access) Act 2009 provides three classes of contracts. Each has different information requirements.

Protected Information 

The Register does not have to publish the following confidential information:

  • The commercial-in-confidence provisions of a contract.
  • Details of any unsuccessful tenders.
  • Any matter that could impact public safety or security.
  • Any information where there is an overriding public interest against disclosure.

Commercial-in-confidence provisions of a contract refer to information that: 

  • Would reveal the contractor’s financing, financial model, cost structure, or profit margins.
  • Could put the contractor at a commercial disadvantage in dealings with the Council.
  • Would disclose any intellectual property in which the contractor has an interest.
